1. Overview
Dinger Derby, LLC ("Dinger Derby," "we," "us," or "our") operates dingerderby.io, a software-as-a-service (SaaS) platform providing baseball analytics packages to individual users, teams, and organizations. This Sales Tax Policy explains how and when we collect, remit, and manage sales tax, use tax, and other applicable transaction taxes in connection with purchases made through our platform.
We are committed to full compliance with applicable tax laws and transparency with our customers regarding any tax obligations that apply to your subscription.
2. Taxability of SaaS Products
The taxability of SaaS products varies significantly by jurisdiction. As a general matter:
- Some U.S. states and jurisdictions treat SaaS subscriptions as taxable digital services or electronically delivered software.
- Other states do not impose sales tax on SaaS or cloud-based software services.
- International jurisdictions may impose value-added tax (VAT), goods and services tax (GST), or other digital services taxes.
Dinger Derby monitors applicable tax law and will collect and remit taxes in jurisdictions where we have a legal obligation to do so (i.e., where we have established "nexus" and where SaaS is taxable).
3. When We Collect Sales Tax
We currently collect sales tax on subscriptions and purchases made by customers located in jurisdictions where:
- SaaS or electronically delivered services are subject to sales or use tax;
- We have established economic or physical nexus under applicable state or local law; and
- No valid exemption applies to the transaction.
If you are located in a jurisdiction where sales tax applies to your purchase, the applicable tax amount will be displayed at checkout prior to completing your transaction and will appear as a separate line item on your invoice.
4. Jurisdiction-Specific Information
4.1 United States
In the United States, sales tax is determined at the state and sometimes local level. Taxability of SaaS products differs by state. For example:
- States such as New York, Texas, and Pennsylvania generally tax SaaS subscriptions.
- States such as California and Florida generally do not impose sales tax on SaaS at this time (though this may change).
We apply U.S. sales tax based on the billing address associated with your Dinger Derby account. It is your responsibility to ensure your billing address is accurate and up to date.
4.2 International Customers
For customers located outside the United States, digital services taxes, VAT, or GST may apply depending on your country of residence or the location of your business. Where required by law, Dinger Derby will collect and remit these taxes on your behalf.
International customers are encouraged to consult with a local tax advisor regarding any additional obligations that may apply in their jurisdiction.
5. Tax Exemptions
Certain customers may qualify for a sales tax exemption, including but not limited to:
- Non-profit organizations with valid tax-exempt status;
- Government entities;
- Resellers with a valid resale certificate;
- Educational institutions, where applicable under state law.
To apply for a tax exemption, you must submit valid documentation to our billing team before your purchase is finalized. Exemption certificates and supporting documentation can be submitted to: billing@dingerderby.io
Dinger Derby reserves the right to review and verify all exemption claims. Approved exemptions will be applied to future invoices; we are generally unable to retroactively refund taxes already collected unless required by applicable law.
6. Your Tax Responsibilities
While Dinger Derby collects and remits tax where legally required, you remain responsible for:
- Any use tax obligations in your jurisdiction if sales tax was not collected at the time of purchase;
- Self-assessing and remitting any applicable taxes in jurisdictions where Dinger Derby does not collect on your behalf;
- Providing accurate billing address information to ensure correct tax calculations;
- Notifying us promptly of any change in your tax status or location.
We recommend that business customers consult with a qualified tax advisor to ensure compliance with all applicable tax obligations.
7. Invoices and Tax Records
All Dinger Derby invoices will include a breakdown of any applicable taxes charged. We retain billing and tax records in accordance with applicable law. If you require a copy of a prior invoice or a tax summary for reporting purposes, please contact our billing team at hello@dingerderby.io.
8. Changes to This Policy
Tax laws and our tax obligations may change over time. Dinger Derby reserves the right to update this Sales Tax Policy at any time. We will post the revised policy on this page with an updated "Last Updated" date. For material changes, we may also notify you via email or through your account dashboard.
Your continued use of the Dinger Derby platform after any changes to this policy constitutes your acceptance of those changes.
